Privacy of data supplied by you

  • The Foundation is committed to ensuring that your privacy is protected.
  • Because the Internet infrastructure is global, and it is not possible to predict the routes that information sent over the Internet will take, the information you provide may be transferred temporarily via a route that takes it outside the boundaries of the Republic of South Africa as it passes between you and the Foundation. By submitting your information, you consent to this transfer.

Losses resulting from unauthorised access to your data

  • While every effort is made by the Foundation to keep secure information submitted by you, you accept the risk that data transmitted electronically via this website or otherwise may be intercepted before reaching its intended destination or accessed by unauthorised third parties and may be exploited unlawfully by such third parties. The Foundation does not assume responsibility for guarding against the acts of such third parties and shall not be liable for any direct, indirect, consequential, special or other damage resulting from third parties’ interception of or access to data of whatever nature including without limitation personal data transmitted by you electronically or otherwise.

Donations

  • All donations to the Foundation are prima facie final, and no right of revocation or refund may be reserved by the donor.
  • However, where it is reasonably apparent that an amount has been donated in excess of what the donor, with all due regard to their personal circumstances and any other relevant factors, would have reasonably intended to donate, the Board of Directors may, in its sole discretion, permit the refund of either part or all of the amounts donated to the Foundation, pursuant to the following:
    • In the event of a bona fide error in relation to the amount of a donation made, a donor must contact the Foundation within 30 days of the donation appearing on their bank, credit card or other similar statement and lodge an official request for a refund in writing.
    • Any refund permitted by the Board of Directors will be paid back at the Foundation’s convenience, which will be determined by the Board of Directors in its sole discretion.
    • The Foundation reserves the right to make restitution in either a single payment or in instalments, so as not to prejudice the Foundation’s going concern ability.
    • Any requests for refunds made more than 30 days after appearing on the donor’s bank, credit card or other similar statement will only be granted in the most exceptional of circumstances; such circumstances to be determined by the Board of Directors in its sole discretion.

General Fund Donations

  • Donations to the General Fund may be disbursed for any purpose associated with the operations of the Foundation, as determined by the Board of Directors in its sole discretion. Such disbursements may include, but are not limited to, administration costs, payroll costs, general operating costs, and disbursements to Candidates of the Fund.
  • The Donor retains no right of request as to how their donation to the General Fund is disbursed, nor does the Donor retain any right to information on how their donation to the General Fund has been disbursed, beyond what is required by South African law and/or what is reported in the audited annual accounts of the Foundation.

Donations in Favour of Specific Candidates (Specific Donations)

  • Donations made in favour of a specific Candidate will be applied solely in favour of that Candidate, subject to the following provisos:
    • Where a donation exceeds the annual amount requested for that Candidate as published on the Foundation’s website, and the Candidate’s candidacy is expected to extend beyond the period for which the annual amount has been requested, the excess will be rolled forward to the next period.
      • Excess amounts will be rolled forward until the Candidate’s candidacy ends
      • Upon a Candidates candidacy ending, any excess amounts will be transferred to the General Fund.
    • Where a donation exceeds the annual amount requested for that Candidate as published of the Foundation’s website, and the Candidate’s candidacy is expected to end at the end of the current period for which the annual amount has been requested, any excess remaining will be transferred to the General Fund.
    • Where a Candidate’s candidacy ends during a period for any reason, any excess amount as a result of Specific Donations will be transferred to the General Fund.
    • The Donor has no right of revocation or refund for any excess amounts in relation to Specific Donations.

Tax Deductibility of Donations

  • The James Christopher Foundation is a registered non-profit organisation (NPO), and as a public benefit organisation under Schedule 9 of the Income Tax Act, 1962, provides so-called section 18A receipts upon request to donors
  • The responsibility for requesting a receipt and determining the tax implications of a donation remains solely with the Donor, and the Foundation accepts no responsibility nor liability for decisions made by the South African Revenue Services in relation to the tax treatment of donations made to the Foundation by the Donor.
